‘Childcarers’ shall herein after be used to name nannies, child minders, babysitters and other childcare professionals.
Agencies and Recruitment companies are not permitted to register.
Childcarers must be legally able to work in the United Kingdom. Parents must pay the nominated fee to become Users and to advertise positions on the Site.
Description of the MTK Service
MTK is an open medium where Users are able to post their details as nannies, babysitters or other childcarers. These details are subject to limited screening by MTK.
These details are available to persons seeking to employ a nanny &/or babysitter or other childcare professional. MTK is not an agency. MTK works as a search and advertising tool for families seeking childcare to locate and contact Childcarers living or willing to work in the areas where the childcare is required.
Using the MTK website
The MTK website may only be used for lawful purposes by individuals and employers seeking childcare related information. The website may only be used by individuals seeking childcare employment, as a nanny, childminder or babysitter, and employers seeking private care for their child or children.
We want to ensure that using the Site is the best experience possible for all Users. If you become a User, you are participating in the site community. You must conduct yourself in a manner that is in the spirit of the community.
MTK prohibits the use of its website for the following, but not limited to, violations. All persons, individuals and otherwise, using the MTK website agree not to use, or allow any person, party or individual under their control use MTK for the following:
• False, incorrect or incomplete postings of biographical information or information which is inaccurate or not your own.
• Searching the MTK c hildcarer database for any purpose other than to find private care for your child or children.
• It is prohibited to use the MTK website in a way that is, or may be seen to be, defamatory, discriminatory (whether racist, sexist, prejudice or otherwise).
• It is prohibited to use the MTK website to:
o Distribute, display or transmit information or content which is of a commercial nature.
o To distribute, display, transmit, store or destroy the MTK website content if it infringes on the copyright, trademark or other intellectual property rights of others or violates an individual's privacy or personal rights.
o Post material that is obscene or contains child pornography.
o It is prohibited for a User to access data not intended for such User. A User may not access or log into a server or account which the User has no authorisation to access. It is prohibited to test, scan or probe the vulnerability of the MTK networks & systems or breach security.
o Attempting to interfere with a Users ability to access or use the MTK website & services, their host or network by, but not limited to, the following means; spamming, sending a virus, flooding, crashing, mail bombing, or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information
o Tampering or interfering with TCP/IP packet headers is forbidden.
o Create an unauthorised link to another website.
o By violating any of the above and any other securities of the MTK systems or networks you risk civil or criminal liability.
o MTK reserves the right to edit, refuse to post, or remove any Information or material it deems as inappropriate.
Using Content on the MTK Website
MTK permits the use & download of a copy of the material provided on the website for your personal use only. The material provided on MTK is not for commercial use. All content provided by & on the MTK are protected under United Kingdom copyright & trademark laws. This includes graphics, software, text, images, logos, icons, button icons & all other website content. All the said content is the exclusive property of MTK. Unauthorized use of MTK's website content may violate copyright & trademark laws. You are in no way permitted to modify or sell the MTK website's content. Using the MTK Service
MTK Users are permitted to search for nannies, babysitters and other childcare professionals and post job ads for nanny or nanny-share positions. Such Users are permitted to view such person's personal details if the User has fully registered and paid for the service. Each User of MTK is permitted to post personal submissions regarding their desire and ability to find a childcare position. MTK charges for access to the personal contact details of nannies, babysitters and other childcare professionals and for job ads. By registering with MTK You agree to provide accurate, current & complete information.
Screening & Vetting
MTK acts as a passive intermediary for the online publication of User submitted information. Screening and vetting of User information is limited. MTK holds no obligation to screen information or communications in advance. MTK holds no responsibility for the screening and vetting of information submitted by Users. The final decision to have communications and/or use information on the MTK site is at your own risk.
If notified by Users of MTK of communications and/or information which does not conform with the MTK Terms & Conditions, MTK may investigate an allegation and determine at its sole discretion whether to remove information or communication.
MTK does not undertake interviewing of childcarers, complete police or other background checks or verify the Information of Site Members. Users are responsible for ensuring that they have complied with the relevant legislation and obtained any required background checks.
Payment
To gain full access to the service provided by MTK, Parents seeking childcare will be required to pay a one-off membership fee for access to the database of Childcarers. Parents will also be required to pay for job ads. Details of Childcarers will only be made available on receipt of payment. Payments may be made using the online payment system provided on the Website.
Costs and terms of the membership criteria are available on the MTK website.
The prices charged for membership are the prices in force at the date and time of your subscription. MTK may alter and change the price and nature of membership. MTK tries to ensure prices are correct and accurate at all times but do not guarantee this. Prices are inclusive of VAT and other applicable taxes.
Once MTK has received payment from you for your membership MTK will confirm this by email. MTK reserves the right to refuse a membership made by you.
You the User undertake to provide true and correct details for the purpose of registering with the MTK service and paying a membership fee to gain full access to the service. You the User undertake to provide true and correct credit, debit or any other electronic switch details, you undertake that the payment method and details you use are your own and that sufficient credit or funds are available to you to use at the time of a MTK membership purchase. These credit facilities and funds must be sufficient to cover the cost of your selected membership purchase.
If you wish to register as a User, You must pay the membership fee using our online payment system. MTK uses military strength encryption to keep credit card numbers safe during the payment transaction. MTK does not keep credit card numbers.
Personal Information Provided by You
By registering with MTK you agree to provide certain personal information herein after to be called "your information". MTK reserves the right to contact users with information and publicity material. MTK reserves the right to offer relevant third party, and otherwise, products & services to you the User. MTK will not disclose your name, telephone number, email address or postal address to any third party without your prior consent. MTK will only disclose such information to a third party when necessary or appropriate or to comply with applicable laws or in legal proceedings where such personal information is required and relevant.
You the User are responsible for all communications. You are also solely responsible for the consequences of posting information on the MTK website. By using the MTK website you agree not to: post obscene, offensive, defamatory, vulgar or abusive material; post material which may be seen to be harassing, hateful, sexist, racist, descriminative or prejudice in any way. You agree not to post material which may be seen as annoying, cause anxiety or inconvenience to another person or entity. You agree not to post copyright material without the explicit permission of the copyright owner; advertisements; chain letters. You agree not to impersonate another person; or material which contains viruses of any kind or use or post any other computer programming method that are intended to interfere with, corrupt or damage data or information.
MTK reserves the right to edit, omit or delete any information submitted by you to the website.
Information by Users of the website is not guaranteed by MTK nor does the information represent the views of MTK, the companies' directors or employees. MTK does not guarantee the truthfulness, reliability or accuracy of communications posted by Users of the MTK site. Nor does MTK endorse opinions expressed by Users. By registering and/or using the MTK website you agree that any reliance on any information contained within the MTK website or posted by Users of the MTK website is at your own risk.

Limitation of Liability
MTK shall not be liable under any circumstances for any loss, damage, expense, or compensation suffered or incurred by the User either directly or indirectly arising from or in any way connected with MTK.
MTK does not guarantee the suitability of any candidate introduced to the User. The final decision to employ a candidate is the sole responsibility of the User. The User shall therefore satisfy themselves as to the suitability of the Candidate and the User shall take up any references provided by the Candidate to it before employing a Candidate. MTK does not accept any liability for any inconvenience, damage or loss arising whether caused directly or indirectly from any act or omission of a Candidate introduced to the User via MTK.
MTK offers no warranty for a nanny, babysitter or other childcare professional's character, honesty, reliability, suitability or capacity. Because of the nature of the Internet user authentication is difficult, therefore MTK does not guarantee or confirm that any User is who they claim to be.
MTK is not responsible for the User and Candidate's contract of employment. These are to be arranged between the User and Candidate. MTK offers a contract of employment only as a guide for the User. MTK cannot and is not held responsible for user to user communications. By using the MTK website you agree to release MTK, our agents and employees, from claims, damages and demands of any kind arising out of or in any way connected with any dispute you the User may have with any other User of the website.
MTK will not be liable for death or personal injury resulting from its negligence.
Because MTK is not involved in actual transactions between Users, in the event that You have a dispute with another User you will need to personally negotiate the resolution of that dispute. You also acknowledge that MTK is in no way responsible for the payment or refund of Childcarer's fees.
Disclaimer of Warranties
MTK does not guarantee the reliability or accuracy of content provided on the site. Nor does MTK guarantee that the service will be without fault or error. MTK does not guarantee that a Users specific requirements will be meet by the websites service.
General
You, the User, are responsible for your password and any information provided by you to the website. Any and all uses of your registration with the MTK website are your sole responsibility. Should there be any unlawful or unauthorized use of your password or registration You agree to notify MTK immediately.
Jurisdiction
These Terms & Conditions shall be construed in accordance with, and governed by, the laws of England and Wales/Scotland/Northern Ireland and the parties submit to the exclusive jurisdiction of the Courts of England and Wales/Scotland/Northern Ireland.
